These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "User") and CODESAAR DIGITAL (MOKENA SKILLS PRIVATE LIMITED) ("Company", "we", "us", or "our"), concerning your access to and use of the https://whatsapp.codesaar.in website as well as our CODESAAR DIGITAL platform and related services (collectively, the "Service").
You agree that by accessing the Service, you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.
Our Service provides a platform that enables businesses to access and use the WhatsApp Business API, provided by Meta Platforms, Inc. ("Meta"), for the purpose of sending and receiving messages with their end-users. This includes providing a dashboard, tools for contact management, campaign broadcasting, chatbot automation, and API access (the "Platform").
You acknowledge that the core messaging functionality is dependent on the availability and terms of the WhatsApp Business API, which is provided by Meta and is subject to change at Meta's sole discretion.
To use the Service, you may be required to register for an account ("Account"). You agree to provide true, accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete. You are responsible for safeguarding your Account password and for all activities that occur under your Account.
Our billing structure consists of two separate components, which you agree to pay:
You are responsible for all applicable taxes (such as GST) in addition to the fees.
You agree to use the Service in compliance with all applicable laws and regulations, and in compliance with all policies set forth by Meta, including the WhatsApp Business Policy.
You are solely responsible for obtaining all necessary consents (e.g., "opt-in") from your end-users before initiating messages to them on WhatsApp.
You may not use the Service to:
We reserve the right to suspend or terminate your Account immediately for any violation of this section.
We own all right, title, and interest in and to the Service, our Platform, and our website. You retain all ownership rights to your own data, such as your contact lists and message content.
We may suspend or terminate your access to the Service at any time, in our sole discretion, for any reason, including for a breach of these Terms or Meta's policies.
You may terminate your Account at any time. Termination will not entitle you to any refund of Subscription Fees already paid.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US DURING THE THREE (3) MONTHS PRECEDING THE EVENT.
These Terms shall be governed by and construed in accordance with the laws of India, and the courts of Kota, Rajasthan shall have exclusive jurisdiction.
